Thanks to the formal opposition of the Parmigiano Reggiano Cheese Consortium, in charge of protecting the PDO worldwide, the Alpina Group's sixth attempt to register the "Parmesano" trademark in Colombia has been stopped. With Decision No. 12177/2023, in fact, the Superintendence of Industry and Commerce issued an important measure for the protection of geographical indications in the Latin American country, denying the registration of the mixed trademark "Alpina Parmesano Snack" on the basis of the Protected Designation of Origin. "This decision," reads a note, "therefore reconfirms the importance of the Free Trade Agreement concluded by the European Union with Colombia, Peru and Ecuador, which allowed the recognition of the protection of the Parmigiano Reggiano PDO in the Andean countries. In fact, the Superintendency, thus confirming the decision issued in the first instance, held that the protection of Denominations of Origin is sufficiently broad that the impediment to registration is not limited to the mere literal reproduction of their name, but also to any kind of imitation, even if only evocative. Therefore, it ruled that the mark applied for, which was claimed for milk, dairy products and especially cheese snacks, including the word 'Parmesano,' was evocative of the PDO Parmigiano Reggiano and therefore not registrable".
