"Within the framework of constitutional balances, judges are 'subject only to the law', which 'realizes the only possible link, in a rule of law, between the judge, who is neither elective nor politically responsible, and popular sovereignty, of which the law, the work of parliamentarians elected by the people and politically responsible, is the primary expression'. In these timely considerations is found the essence of the independence of the judiciary as an inalienable asset of the rule of law and our constitutional democracy". These are the words of the President of the Republic, Sergio Mattarella, who yesterday cited a recent Supreme Court ruling in his speech at the inauguration ceremony of the third headquarters of the Higher School of the Judiciary and presentation of the 2023 training year, in Castel Capuano, in the province of Naples. "It is essential," the Head of State added, "that the process, both civil and criminal, become a more agile and modern tool to adequately pursue the objectives for which it is prepared. It is necessary that the government and Parliament, the judiciary and the legal profession, work to achieve this result".
