Adoption ruling in record time by the Trento Juvenile Court for a child just under four years old born through surrogacy abroad and raised by a male couple residing in Trentino. In just four months from the filing of the petition, the panel granted the use of "stepchild adoption" by the social father for the purpose of protecting the child in the event of the disappearance of the biological father, who is seriously ill. The same-sex couple, recognized in the child's birth certificate in Canada but not in Italy, approached the court because of the biological father's illness and because of the impossibility of registering a child with same-sex parents at the registry office. The biological father turns out to have a disease that not only forces him to long hospitalizations, but could lead to his death. The possible outcome of the disease, along with the peculiar condition of the child and his caregiver, was one of the elements taken into consideration by the panel charged with evaluating the case. The risk feared by the college is that the child, in the event of the biological father's death during the adoption process, which usually takes a very long time, would remain in a state of abandonment. Until the end of the planned procedure, the social father is in fact under Italian law a complete stranger to the child. Given the complexity of the case and the health condition of the biological father, along with the actual risk to the protection of the child's interests, the Juvenile Prosecutor's Office itself immediately gave a positive opinion to the homogenous couple's petition, requesting, however, that the request to register the second father in the registry office, which is not provided for in the legislation, not be followed up.
