Asylum seekers arriving in Italy will be required to provide a "financial guarantee of 4,938 euros" in order to avoid remaining in CPRs. This is the rule enshrined in a Ministry of the Interior directive that is reshaping Italian politics. The decree, which was published in the Official Gazette, addresses "the indication of the amount and methods of provision of the financial guarantee to be paid by the foreigner during the procedure for determining the right of access to the territory of the State." Article 1 defines "financial guarantee" as "appropriate when the amount fixed is capable of guaranteeing to the foreigner, for the maximum period of detention, equal to four weeks (twenty-eight days), the availability of: a) adequate accommodation on the national territory; b) the amount required for repatriation; and c) the minimum means of subsistence necessary per person." Article 2 states that "the amount for the provision of the financial guarantee is identified in € 4,938.00 for the year 2023. The sum is updated every two years, based on the definition of the average cost of repatriation". Article 3 states that "the financial guarantee is provided in a single installment by means of a bank guarantee or insurance guarantee policy, is individual, and cannot be paid by third parties. The financial guarantee must be delivered within the time frame of the photodactyloscopic and signaling processes". So, article 4 adds that "in the event that the foreigner leaves unlawfully, the prefect of the place where the financial guarantee was provided proceeds to enforce it”.
