Constitutional Court green light for inmate sex with partner. The Court declared illegitimate the obligation for custody officers to visually monitor interviews: the inmate has the right to affectivity, a value that is protected by the legal system and guaranteed by the European Convention of Rights; an affectivity "that does not imply, but neither does it exclude sexuality”, which is already allowed in some European countries. It is therefore up to the legislature to create appropriate spaces in prisons for intimate talks - as exist in France, Spain and many German states - which would in any case be barred to mobsters. That's the Constitutional Court's ruling, filed January 26, declaring it illegitimate: the court abolishes the provision that interviews must always be watched on sight by officers, even when there are no security reasons.
