Smart working is no longer a right and no longer a duty. In fact, the rules envisaged during Covid-19 in favor of so-called frail individuals and parents of children under 14, which in Italy allowed to request the activation of agile work even without prior consent of the employer, expire on March 31. Therefore, from April 1, the ordinary rules will apply to all workers, which means, first of all, the need to have the company's green light. However, the opposite will also be mandatory: no worker will be able to be put into smart working against his or her will. Agile working was one of the first measures identified as a solution to the total work stoppage due to the coronavirus emergency. To this end, a kind of liberalization had been decided, that is, applicability even in the absence of agreements with the employer. The latter could arrange it even without the employee's consent. As of April 1, the agreement becomes mandatory again.
