The generalized extensions of state-owned concessions to beach establishments are illegitimate, as they also contradict the Bolkestein Directive. The Council of State reaffirmed this with three rulings related to the judgments of the Supreme Court and the Court of Justice. Therefore, the illegitimacy of the extensions of state-owned maritime concessions for tourism and recreational purposes, as established by the legislature, is reiterated as they conflict with the principles of competition and freedom of establishment enshrined in the Bolkestein Directive and Article 49 of the Treaty on the Functioning of the European Union.
