A couple from Milan, together for more than 50 years, saw their dream of getting married fade away due to a bureaucratic error by the Municipality. The woman's partner, who was ill in 2021, had asked his lawyer to start the procedures for an emergency marriage. The formal request, complete with a medical certificate, was sent via certified mail (PEC) to the municipality, which only replied on 1 March, but with an ordinary email, not readable by the lawyer's PEC. This error prevented the couple from receiving the reply in time, and the partner died on 3 March without being able to celebrate the marriage. The Court has now condemned the Municipality of Milan to compensate the woman with 15,000 euros for moral damages, pointing out that a telematic ceremony would have been possible on 1 March, in line with the emergency measures of the pandemic. The woman also claimed compensation for pecuniary damage, calculated on the basis of her partner's survivor's pension, totalling around 230,000 euros. The municipality intends to appeal the sentence, considering that the court did not adequately consider the organizational difficulties related to the pandemic period.
