According to the Court, Margherita Agnelli, who has been unrelated to the company for 20 years, cannot be considered among those directly affected by Dicembre's registration arrangements. The decision comes after an earlier appeal filed by Margherita Agnelli was already rejected in April 2024. Her lawyers challenge the court's reasoning, pointing out that the lack of interest in the action is based on the idea that the contested registrations have a purely formal value, with no impact on substantive issues such as the validity of the company's acts. They also pointed out how this ruling contrasts with an earlier decision by the same court, which had instead recognized Margherita Agnelli's interest in acting in relation to the affairs of the Dicembre company, which is currently the subject of further investigations in both civil and criminal matters.
