With judgment no. 64 of 2025, the Constitutional Court declared the illegitimacy of Article 1 of Campania Regional Law no. 16/2024, which sought to exempt the President of the Regional Council from the prohibition on serving a third consecutive term. According to the Constitutional Court, this prohibition - enacted by State Law No. 165/2004 - represents a fundamental principle in electoral matters for Regions with ordinary statutes, as it balances the power of direct election of the regional president with a limit on the number of consecutive renewals of the office. The Court emphasized that the fundamental principles, even if they are formulated in a precise manner, can have general value and do not require explicit transposition by regional laws to be obligatory. In this specific case, the Campania Region had already implicitly adopted the ban in a 2009 law, referring back to existing state regulations. The subsequent 2024 exception—which would have allowed the outgoing president to run again despite two consecutive terms—was therefore judged as unconstitutional. Ultimately, the Court clarified that the failure to challenge similar laws in other regions does not compromise the validity of the principle, which can still be invoked incidentally.
