The European Union's General Court ruled in favor of Ferrari, which claimed ownership of the "Testarossa" trademark, one of the most recognizable brand names in automotive history. The case arose from a 2015 revocation request filed by Kurt Hesse, owner of the German toy business Autec, who had also registered the "Testarossa" trademark in 2014. Hesse claimed that Ferrari did not make true use of its trademark between 2010 and 2015, a time that, according to European Union Regulation, is sufficient to result in the termination of rights for non-use. However, the EU General Court determined that the trademark had been used by authorized auto dealers and distributors, which could be traced back to Ferrari. Ferrari was capable of proving that the third-party use had taken place with its implicit consent and that it had maintained active control over the trademark's use. As a result, the automaker retains ownership of the trademark.
