The additional act to the contract between the Strait of Messina Company and Eurolink, regarding the construction of the bridge over the Strait of Messina and the road and rail links, introduces penalties for both the public and private parties. In case of work stoppage attributable to the Messina Strait Bridge or withdrawal of the Eurolink company, the penalty provided is 5% of the unperformed work, up to a maximum of four-fifths of the value of the contract, half the amount provided for in Article 123 of the Procurement Code. To protect the public interest, the act also establishes penalties to be paid by the general contractor in case of breach of contract, which may exceed one million euros for each day of delay. A bond of more than 650 million euros is also provided to guarantee the obligations undertaken, enforceable in case of non-performance. The additional act will come into effect after registration with the Court of Auditors and publication of the CIPESS resolution in the Official Gazette.
