For two weeks, he relentlessly attempted to win back his ex-partner, bombarding her phone with daily calls and messages. No threats or insults, just a continuous and unpleasant presence. As a result, the Court of Cassation upheld the man's conviction for harassment imposed by the Vibo Valentia court. According to Il Messaggero, between December 13 and 31, 2022, the male constantly contacted the woman, sending her dozens of messages and calling her many times every day. Exasperated, she filed a complaint and provided investigators with evidence of the communications. In his defense, the defendant claimed that there was no evidence of the woman's true psychological anguish and that the time frame was insufficient to constitute a crime. He also stated that his ex had never blocked his number. The Supreme Court, however, dismissed all of the defense's claims. The judges described the man's actions as "pressing and indiscreet", motivated by "petulant and inappropriate" behavior, and consequently "inspired by a blameworthy motive". The victim's ability to block the messages was deemed irrelevant, as the ruling implies that "the possibility of interrupting the disruptive action arises only after the harassment has already occurred". Furthermore, the Court stated that the duration of the psychological discomfort is irrelevant: even a brief change in the victim's mental condition is sufficient to prove harassment.
