The Court of Justice of the European Union will be required to determine the legality of Italian regulations concerning the cultivation and marketing of light cannabis. At the core of the dispute lies the conflict between national legislation, which persistently bans the use of cannabis leaves and inflorescences even when the active ingredient remains within the limits established by the European Union, and EU regulations that govern the free movement and utilization of agricultural varieties registered in the European Common Catalogue. A network of enterprises and associations, including many producers, filed the complaint against the Ministries of Agriculture, Health, and the Environment. The plaintiffs contend that the Italian prohibition impedes the lawful utilization of even the non-psychoactive components of the plant (leaves, inflorescences, oil, and resin), thereby hindering the advancement of an agricultural and industrial sector acknowledged in numerous other European nations.
