2,111 requests for reimbursement of legal fees, filed by defendants definitively acquitted, have been accepted over the past three years, totaling approximately €12 million. The Fund to reimburse legal fees for acquitted defendants was established by a 2021 law. Recipients of a definitive acquittal rendered "because the fact does not exist," "because the defendant did not commit the act," or "because the act does not constitute a crime or is not provided for by law as a crime," are eligible for reimbursement, excluding cases where the latter ruling was issued as a result of the decriminalization of the facts in question. Excluded are those who, despite having been acquitted on some counts, were convicted on others; those whose crime was extinguished due to the statute of limitations or amnesty; those who benefited from legal aid in the same proceedings; those who obtained a judgment against the plaintiff to repay the costs; Anyone already entitled to reimbursement of legal fees from their employer. Reimbursement is granted up to a maximum of €10,500.00 and is paid within the year following the year in which the judgment becomes final. In the event of the defendant's death, the request may be submitted by the heir.
