The International Criminal Court has referred Italy to the Assembly of Member States for failing to comply with a request for cooperation in the Almasri case. The Court itself announced this, explaining how the decision was formally sent to the President of the Assembly by the Court's President on January 29, 2026. The measure is based on what the Pre-Trial Chamber I established on October 17, 2025, when the Court determined that Italy had not met its international commitments under the Rome Statute. According to the ICC, the Italian authorities did not carry out the request to arrest and surrender Almasri (Njeem) while he was on national territory, nor did they initiate a discussion with the Court to resolve any critical issues regarding the arrest warrant or potential competing extradition requests. The Court also stated that it invited an Italian representative to the Bureau meeting of the Assembly, held on April 1, 2026, to discuss the consequences of the lack of cooperation and outline how Italy intends to cooperate in the future. The Bureau will now present a report with potential recommendations to the next session of the Assembly of Member States, which provides advice, control, and oversight to the International Criminal Court.
