For the first time in Italy, the Bari Court of Appeal recognized a child with three legal parents: a mother and two fathers. The decision, which was issued in January and is now definitive, officially establishes that the child is the son of the woman who gave birth to him and the male couple who have raised him since birth. The case relates to a child born in Germany to a woman who is a friend of the fathers, without the use of surrogacy. The child was conceived naturally and was immediately identified by both the mother and the biological father. Subsequently, the father's partner indicated his desire to recognize him, receiving consent from a German judge, where the three live permanently and this form of adoption is legal. The couple then asked that the birth certificate be transcribed in Italy, specifically in Puglia, where the second father is registered with AIRE. However, their request was initially denied by a Puglian municipality. The case thus reached the Bari Court of Appeal, which upheld the appeal and ordered the full transcription of the birth certificate in Italy, citing the German judge's decision. With this decision, the kid is acknowledged in Italy as the child of a mother and two fathers.
